## Why is rebuilding a below-grade apartment different from repairing one?

Rebuilding an English basement apartment after a flood in DC is not the same job as repairing one. Strip a below-grade unit back to masonry and joists and the work stops being covered by what was approved years ago. A repair puts back what was there. A rebuild of any real size asks a reviewer a question the original unit may never have had to answer, and the answer comes from the code in force today.

That matters below grade more than anywhere else in a row house. A second-floor kitchen goes back the way it came out. A dwelling unit set below the sidewalk grade behind a front areaway has to satisfy rules about getting out in a fire, about how tall the finished space is, and about daylight and fresh air. Those rules are why a flooded English basement turns into a permit conversation while the drying equipment is still running.

This is a reason to decide early, not a reason to panic. The cheapest version of this project is the one where the owner settles what the space will be on the day the walls come out.

## What does gutting the unit re-open: egress, height, light and ventilation?

Four questions come back into play the moment the finishes are gone. Can a person get out of a sleeping area without using the stair that may be on fire. Is the finished ceiling tall enough for habitable space once the new floor assembly and any duct soffits are counted. Does the unit get enough glazing for natural light. Is there enough ventilation for the rooms that need it.

We do not publish the numbers here. They belong to the District's adopted construction codes and they change when those codes are updated, so a figure repeated on a contractor's blog is the worst source. The DC Construction Codes are published by the Department of Buildings, and they are the document a plan reviewer will be holding.

Egress usually bites first, because adding a window well or enlarging an opening in a masonry wall is structural work with a lintel, a footing and a drainage detail. Ceiling height is second, because a slab you cannot lower and joists you cannot raise leave little room to negotiate.

- Egress: a below-grade sleeping room needs a way out that does not depend on the interior stair, which in a row house usually means a rear window well or a direct exterior door.
- Ceiling height: the governing dimension is measured after the new floor build-up and any duct soffits, so a design that ignores the ceiling plan loses inches it cannot get back.
- Natural light: glazing area is tied to the floor area it serves, which is why a long narrow unit with one small front window is the hard case.
- Ventilation: rooms need operable openings or a mechanical system sized for them, and an interior bathroom needs a duct route that survives the joist layout.

## How does the certificate of occupancy fit into a flood rebuild?

A certificate of occupancy is the District's statement of what a building, or a part of a building, is approved to be used as. DC Code 6-1405.01 puts building permits and certificates of occupancy under the same Building Code Official, which is why a rebuild and an approval question tend to arrive together. A separate dwelling unit below grade is a use. It is what an owner leans on when a tenant, a lender or a buyer asks whether the unit is really a unit. A flood does not cancel it. A rebuild can put it back in play, because the certificate follows an approved configuration rather than a room.

This is where owners get surprised. Plenty of English basements were finished decades ago with no approval at all, and the family that bought the house inherited a space everyone treated as a rental. Others were approved as storage or as part of the single house above rather than as a second unit. A flood is often the first time anyone reads the file.

What we can do is flag early when a scope is heading toward a question we are not the right party to answer, so an owner can bring in a designer or counsel before demolition.

## What does 'like for like' mean, and when does it stop applying?

Insurance language and code language use the same words for different things. An adjuster writing like for like means the same quality of finish: the same grade of flooring, the same trim profile, the same cabinet line. A building official is asking something else, which is whether the work repairs existing approved conditions or alters them in a way that brings current requirements with it.

In practice the line falls at the wall. Pull the finishes, dry the cavity, and put the same layout back, and most of that reads as repair. Move a partition, add a bedroom, cut a new opening in masonry, or finish a space never approved as living space, and you have crossed over.

## How do you protect the unit against the next flood while you are open?

An open below-grade space is the one chance to fix the reason it got wet. That work is separate from the rebuild and should be priced separately. The rebuild decides what the room will be. Waterproofing decides whether it stays dry.

Start by naming the water. Groundwater under pressure, surface water pouring down an areaway and a backup through the building drain all look identical on the floor and call for different work. The fix for one does nothing for the others, which is how an owner installs a sump for what was really a sewer problem and floods again.

- Fix the source before the finishes: a backwater valve, a sump and pit, an areaway drain or a repaired lateral.

- Photograph the open cavity before it closes, with framing, plumbing and waterproofing visible. That record is worth more than anyone expects two years later.

## What materials belong below grade and which ones should never go back?

Below grade, every material is a bet on how it behaves when it gets wet again. The bet you want is that water passes through, dries out and feeds nothing. Paper-faced gypsum on untreated studs at the base of a masonry wall is the opposite bet, and it is what we cut out of these units most often.

Better material choices do not make a space flood-proof. What they do is shorten the next event from a gut to a mop-out, which is the difference between weeks of displacement and a couple of days. The EPA's mold guidance says absorbent or porous materials such as ceiling tiles and carpet may have to be thrown away if they become moldy. The IICRC S500 standard drives the same call from the water category and whether the material can actually be dried, which is why a clean-water soak and a sewage backup produce very different demolition lists.

## How do you handle the tenant, the rent and the displacement period?

A flooded English basement with a tenant in it is two problems at once. The building problem runs on a schedule. The housing problem has a person inside it and moves faster. Handle the second one in writing from day one, because memory of a phone call is not a record.

Put the basics on paper early. What is uninhabitable and why. What the plan is. What the expected window is, stated as a range and updated whenever it moves. Whether rent is abated, reduced or held. Where the tenant's belongings are stored and who pays for storage. An owner with those notes is in a far better position than one who managed it all by text message.

Landlord and tenant obligations in the District are their own body of law, and not something to work out from a contractor's opinion. Talk to counsel or to the District's housing resources early, especially if the displacement will run long.

## Does insurance pay for code-required upgrades?

Sometimes, within a limit, and only when the policy carries the right coverage. Many dwelling and landlord policies include an ordinance or law provision that pays part of the extra cost of meeting current requirements during a covered repair. It is normally written as a percentage of the dwelling limit.

Read the declarations page and the endorsement it references before you argue about it. Then split the estimate into three blocks: the mitigation, the repair of what was damaged, and the upgrades the code is forcing. An adjuster can consider that third block only when it arrives as its own scope with the requirement named. Buried inside a drywall line, it reads as padding.

The other coverage worth finding is loss of rents, sometimes called fair rental value, which responds to the income the unit produced while it cannot be occupied. It carries its own limit and time period, separate from the building coverage. If a claim goes sideways, the District's insurance regulator handles complaints.

## What does the rebuild sequence look like from gut to re-occupancy?

The order is close to fixed, and most delays come from skipping a step. Mitigation first, then the decision about what the unit will be, then design and approvals, then structural and mechanical work, then finishes. Money spent out of order tends to get spent twice.

The dry standard is the hinge in the middle of it. Nothing closes up and nothing goes down on the slab until the readings say the assembly is dry, measured against a dry material in the same building rather than a number someone likes. The IICRC S500 standard describes how that is established, and a contractor working below grade should be able to talk about it unprompted.

- 1. Stop the water and extract, then set drying equipment and record readings daily.
- 2. Remove what cannot be dried: the base of the wall, wet cavity insulation and flooring on the slab.
- 3. Decide what the unit is going to be. This is the real decision point, and it comes before any drawing.
- 4. Bring in a designer or engineer if egress, height, structure or a change of use is in play.
- 5. Obtain the permits the scope requires, and expect a new masonry opening to need a structural detail.
- 6. Do the exterior drainage and sewer work while the inside is open. Access will never be cheaper.
- 7. Frame, rough in the mechanicals and insulate. Get the concealed work inspected before anything is covered.
- 8. Confirm the slab and the walls read dry, then close up and finish before scheduling the final sign-off.

## What should you decide before demolition rather than after?

Every expensive surprise in a project like this traces back to a decision that was available on day one and got deferred. The gut is the cheap moment. Once framing is up and drywall is hung, changing the answer means undoing work you just paid for.

Run the list below before the first wall comes out. Bring the answers to whoever prices the rebuild, because a contractor who knows what the unit will be writes a scope instead of a guess.
